These Terms and Conditions are designed to make sure all telephone
transactions are conducted appropriately and that the www.pricestorm.com
website is a secure place to trade. They set out the full terms
of the relationship between you and PriceStorm.com in connection
with this website and any orders placed with us, via but not limited
to, our website (www.pricestorm.com), email, facsimile transmission,
or telephone. Whenever you place an order with PriceStorm you are
accepting the following terms and conditions. Please take
the time to read them carefully.

What You
Can Expect From Us
No contract for the sale of any goods will subsist
between you and PriceStorm unless and until PriceStorm
accepts your order by charging in either full or
part, your credit or debit card, against payment
for goods ordered. PriceStorm will send an email
(in instances where a customer has provided an
email address for correspondence) confirming despatch
of the goods you have ordered and/or issue you
with a unique order reference which may be advised
via email or telephone as applicable.
Credit and Debit cards are charged at the time
of ordering. All prices include sales taxes (where
applicable) unless otherwise stated. Delivery charges
are also applicable.
The confirmatory e-mail (if applicable), will
contain all relevant statutory information concerning
your purchase from PriceStorm.
Your confirmation email will include a hypertext
link to these Terms and Conditions, which may be
amended from time to time in accordance with clause 18.
PriceStorm will not pass on your personal details
to any third party, without your consent.
This clause should be read in conjunction with
our Returns Policy, which can
be found at on the reverse of our despatch note
or by visiting www.pricestorm.com/returnspolicy or
in hard copy format which is available upon request
by telephoning our Returns department.
We accept cancellations either by email to returns@pricestorm.com,
online using the “Cancel Order” feature in the “Order History”, or by faxing your request to cancel in writing
to our Returns department 0870 050 1080 (10am-5pm – Mon-Fri,
excluding Bank holidays), no later than
7 working days from the day after you
receive the goods:
if you notify us of cancellation by email
to returns@pricestorm.com, please ensure that
you quote your name, address and order reference
number, (which can be found on your email order
confirmation or despatch note). If telephoning
for assistance or to query any part of the
returns process, please ensure you have your
order reference to hand as this will speed
up the process, and allow us to advise you
more promptly.
where you have already received the goods,
returning the goods to PriceStorm unopened,
and in the same condition that they were received,
together with the original despatch note, no
later than 7 working days from the
day after you received the goods.
upon receipt of notification that you wish
to withdraw from the contract (in accordance
with these terms) any sum(s) debited to PriceStorm
from your credit or debit card in relation
to your order will be re-credited to that credit
or debit card account as soon as possible and
in any event within 30 days of receipt of return
of your order provided that the goods you wish
to return are received by PriceStorm in pristine
condition, unopened and unused and returned
in accordance with our Returns Policy.
PriceStorm does not accept liability (except
as set out below) for any errors and omissions
and reserve the right to change information, specifications
and descriptions of listed goods, products, services,
and prices without notice. PriceStorm reserves
the right to cancel or refuse any order which,
through an act of error or omission has been incorrectly
priced. Any charges made will be refunded in full.
PriceStorm do not exclude or limit any liability
for (a) personal injury or death, where such injury
results from PriceStorm’s negligence or wilful
default, or that of PriceStorm’s employees,
agents or subcontractors or (b) fraudulent misrepresentation.
TO THE FULLEST EXTENT PERMITTED BY LAW, PRICESTORM
PROVIDES A WEB SITE AND ANY ASSOCIATED ADVERTISING,
THE CONTENTS OF WHICH ARE ON AN "AS IS" BASIS
AND MAKES NO (AND EXPRESSLY DISCLAIMS ALL) REPRESENTATIONS
OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED,
WITH RESPECT TO THIS WEB SITE OR THE INFORMATION,
CONTENT, MATERIALS OR GOODS INCLUDED IN THIS SITE
INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE. IN ADDITION,
PRICESTORM DOES NOT REPRESENT OR WARRANT THAT THE
INFORMATION ACCESSIBLE VIA THESE MEDIUMS IS ACCURATE,
COMPLETE OR CURRENT.
PriceStorm accepts NO LIABILITY for
any indirect loss, consequential loss, loss of
data, loss of income or profit, loss of damage
to property and/or loss from claims of third parties
arising out of the use of the PriceStorm website,
advertising or for any goods or service(s) purchased
from the PriceStorm.
PriceStorm will only be liable for direct loss
up to a maximum total of the price of the goods
or service purchased in respect of any claim made.
In the unlikely event that you receive goods
which were not what you ordered or which are damaged
or defective, PriceStorm shall, at its own option,
make good any shortage or non-delivery, replace
or repair any damaged or defective goods, or refund
to you the amount you paid for the goods in question ON
THE EXPRESS CONDITION that you notify
PriceStorm of the problem via e-mail (info@pricestorm.com)
or by calling during normal office hours (9am-5.30pm)
on 0870 050 1060 within 7 working days
of day after receipt of the goods (receipt
shall be deemed to have taken place 5 workings
days after despatch). This does not affect your
statutory rights.
All aspects of the contractual purchase agreement
and payment thereof, between you and PriceStorm,
will be governed by the laws of the Island of Guernsey,
Channel Islands.
All delivery times quoted are approximate. All
deliveries are made to the address given by you
either online, via email, facsimile transmission
or telephone. Please note that orders may be part
shipped in more than one package.
If your delivery address is outside of Guernsey
you maybe subject to government imposed import
duties and taxes, which are levied once a shipment
reaches the destination country. Any such additional
charges for customs clearance must be borne by
you. It should be noted that customs policies vary
greatly from country to country. PriceStorm would
advise any customer to contact their local customs
office for more detailed information relating to
their country of destination. Please also note
that cross-border shipments may be subject to opening
and inspection by customs authorities.
Title of goods will pass only upon receipt of
full payment.
PriceStorm may amend these terms and conditions
from time to time. At such times PriceStorm will
issue them as a new version at www.pricestorm.com ,
and these are also available in hard copy upon
request. All purchases made from the new version
issue date will be governed by those terms.
PriceStorm try as hard as possible to ensure
information relating to goods and services is current
and accurate. However we can not always guarantee
that information and/or prices have not been changed
by our suppliers. PriceStorm will do its best to
correct errors and omissions as quickly as practicable
after being notified of them.
PriceStorm shall not be liable for any delay
or failure in performance of any part of this Agreement
or any Service Order(s), other than for any delay
or failure to pay money, to the extent that such
delay or failure is caused by fire, flood, explosion,
accident, war, strike, embargo, governmental or
regulatory requirement, civil or military authority,
Act of God, civil unrest, inability to secure materials
or labour or any other causes beyond its reasonable
control.
What We
Expect From You
It is your responsibility to ensure PriceStorm
hold your correct personal details (in relation
to orders placed) and that PriceStorm can not be
held responsible for any errors or delays relating
to the inaccuracy of information held on our records.
You undertake that all details provided to PriceStorm
for the purpose of ordering or purchasing goods
or services are correct, that the credit or debit
card you are using is your own (or you are an authorised
user) and that there are sufficient funds to cover
the cost of the goods or services ordered.
You accept that email can be used, and is an
acceptable means of long distance communication.
Your contract for purchases is with PriceStorm,
and you undertake that any and all goods ordered
by you are for your own private and domestic use
only.
It is illegal to use or give out a false name
or a known invalid credit card to purchase goods.
Individuals proven or suspected to be wilfully
entering an erroneous or fictitious order will
be refused custom and/or prosecuted to the fullest
extent of the law.
Miscellaneous
These terms and conditions shall supersede
any and all other conditions, understandings,
commitments, agreements or representations relating
to your purchase, whether oral or in writing,
and contain the entire agreement between PriceStorm
and you relating to your purchase.
If any provision of this Agreement is held
by a court or any governmental agency or authority
to be invalid, illegal, or unenforceable, such
provision shall (to the extent possible) be
severed from this Agreement and the remainder
thereof shall nevertheless remain legal, valid,
and enforceable.
These terms and conditions are subject to
the laws and exclusive jurisdiction of the Island
of Guernsey, Channel Islands.
